TERMS OF SERVICE

Last Updated: May 9, 2026
This Terms of Service for Ellen McDowell Design (doing business as Flare Family and Flare Family Tracker) ("we," "us," or "our"), describes the use our app ("App"):

THIS APP IS NOT A MEDICAL DEVICE AND DOES NOT PROVIDE MEDICAL ADVICE. ALWAYS SEEK THE ADVICE OF YOUR PHYSICIAN REGARDING A MEDICAL CONDITION.

1. Acceptance of Terms
By creating an account and checking the mandatory agreement box, you provide Affirmative Express Consent to these Terms of Service and our Privacy Policy. This forms a legally binding contract between you and Flare Family. If you do not agree, you may not use the Service.

2. General Wellness & "Calculator" Status
In accordance with the January 2026 FDA General Wellness Guidance, Flare Family Tracker is a digital diary and mathematical tool.

The "Calculator" Logic: The App summarizes your self-reported inputs (pain, stiffness, fatigue, morning stiffness, brain fog) into mathematical averages (μ = Σx / n). These are informational summaries and averages, not clinical diagnoses. For prefilled self-reported outcomes, the answers are selected based on averages of all flares that occured in the last 7 days leading up to an appointment. The self-reported outcomes are not scored as that process is performed by medical professionals, usually at or after the appointment. The purpose of the prefilled outcomes is to serve as a starting point for users that may be having a hard time remembering pain/stiffness levels leading up to their appointment. The prefilled outcomes should ALWAYS be reviewed for accuracy and edited by users before using the PDF export feature, or before showing the app interface to a medical professional.

No Medical Claims: We do not claim to treat, cure, or manage Rheumatoid Arthritis. The Service is for personal awareness of lifestyle trends.

3. Use of Information and Aliases
We encourage privacy. You are not required to provide your legal name to use the App; aliases are permitted and supported. You are responsible for the accuracy of the data you input, as the App’s calculations are entirely dependent on user-reported information.

4. Exporting Reports
While the App provides a feature to export logs for discussion with healthcare providers, Flare Family assumes no liability for the interpretation of these reports or their security during transit. Every report contains a mandatory footer: "Self-reported wellness journal. Not for clinical use."

5. Limitation of Liability
To the maximum extent permitted by law, Flare Family shall not be liable for any medical outcomes or decisions made based on the data contained within the App. Use of the App is at your own risk.

6. Deletion of Data
Consistent with 2026 Privacy Regulations, you have the right to be forgotten. Deleting your account will remove your personal data (User, Flare, and TreatmentHistory entities) from our active database.
